Election Commission's notice to Anbumani

New Delhi: The Election Commission on Monday issued a notice to Union Health Minister Anbumani Ramadoss on a petition alleging that he was holding an office of profit by being the president of the All-India Institute of Medical Sciences.

Sources said the notice was issued on a petition forwarded by President A.P.J. Abdul Kalam which he received from Omesh Saigal, a retired IAS officer, seeking disqualification of Dr. Ramadoss from Parliament.

The Minister had been given time till August 28 to file his response.

The Commission also issued notice to Mr. Saigal asking him to substantiate his allegation and submit his response by August 28.

The sources said both the complainant and the Minister would be given opportunity to argue their case through lawyers.

They would be asked to file their written submissions and a final decision would be conveyed to the President as per the provisions of the Constitution.

Under Section 3 of the Parliament (Prevention of Disqualification) Act, 1959, holding of certain offices of profit will not attract disqualification.
