HYDERABAD: A Division Bench of the High Court on Thursday asked the Government to inform it about the extent of temple lands acquired and amounts still to be paid as compensation. The Bench was making it clear that it was not inclined to vacate the interim orders passed earlier restraining the acquisition of Hindu temple lands for the purpose of construction of houses under the Indiramma scheme. The Bench was dealing with petitions filed by the State Government seeking to vacate the interim stay orders in two separate writ petitions filed by Kamal Kumar of Devalaya Parirakshana Samithi and the Andhra Pradesh Archaka Samakhya.
Act challenged
The petitioners had filed the writ pleas in May and complained to the court that without following due procedure the temple lands were being acquired. The Devalaya Parirakshana Samithi challenged the constitutional validity of Section 80 of the Endowments Act, which provides for alienation of the temple properties. The Bench in May made it clear that no temple lands shall be taken possession by the Government for the Indiramma scheme. On Thursday, the petitions filed by the Government came up for hearing and after hearing the petitioners at length the Bench posted the matter for final hearing in September and made it clear that the Government would submit the details of the temple lands acquired so far and the amount of compensation still due.
