Order on plea challenging bail reserved

Kochi: The Kerala High Court on Wednesday reserved its order on a petition filed by the Government challenging the bail granted to Sobha John, the prime accused in the Sabarimala Thantri assault case.

The order was reserved by Justice K.R. Udayabanu. While admitting the Government petition, the Judge had earlier stayed the order of the chief judicial magistrate.

The State Government opposed the bail to Sobha saying she was the chief conspirator in the case. Considering the gravity of the crime, the police requested that Sobha John should not be granted bail till another key accused, Bechu Rehaman, an actor, was arrested.

Director-General of Prosecutions P.G. Thampi submitted that all efforts were being made to book Rehaman who is absconding. He had allegedly arranged the six-member gang to assault the Thantri. The DGP also produced the case diary as directed by the court.

Fixation of fee

Justice S. Siri Jagan fixed the fee for the students who had got admission for the management quota in the M.B.B.S courses in the Pariyaram Medical College during the academic year 2003-04 at Rs.2,16,375.

The court fixed the fee while allowing a writ petition filed by as many as 34 MBBS students challenging the demand for Rs.4 lakhs as fee from them.

The court also ordered the medical college principal to either refund the amount collected in excess of Rs. 2,16,375 or adjust against the future tuition fee. The court held that fee fixed by the K.T.Thomas Committee should be taken as fee prescribed for management quota students admitted in 2003-04.

Full Bench decision

A Full Bench of the Kerala High Court on Wednesday confirmed the ruling of a Division Bench that the managements of the minority institutions had the right to choose a qualified teacher as Head Master or Principal of the institution. The Bench, however, held that the selection of the Head Master or Principal should be made in a reasonable and transparent manner.
