High Court summons MCD Commissioner

Seeks details about unauthorised constructions


  • CBI directed to conduct probe into illegal properties in Rohini Zone
  • Monitoring Committee's report criticises incompetence of the civic body

    NEW DELHI: The Delhi High Court on Friday summoned in person the Delhi Municipal Commissioner seeking to know what plan the civic body has chalked out to act on reports submitted by the Court-appointed Monitoring Committee about unauthorised constructions in the Capital.

    A Division Bench comprising Justice Vijender Jain and Justice Rekha Sharma directed the Municipal Commissioner to appear in the Court on August 31 along with all details about unauthorised constructions and action taken against the violators. The Bench has been hearing public interest litigation by Kalyan Sanstha Social Welfare Association in the matter.

    The Bench also directed the Special Investigation (SIT) team of the Central Bureau of Investigation to conduct a probe into illegal properties that had come up during the tenure of the Deputy Commissioner, G.S. Matharoo, in Rohini Zone. Meanwhile, the Monitoring Committee in its report submitted to the Court said the pace at which the civic body was carrying out demolition of unauthorised constrictions in the city, it would "take 263 years to finish the task".

    "The Court will be disappointed to know that the MCD will require 263 years to carry out demolitions ordered by it between 1990 and June 30 2006,'' the report observed.

    The report said it was a clear-cut case of incompetence, collusion and corruption on the part of those who were managing the affairs of the local body. The report suggested setting up of a centralised demolition unit for a short term and an independent enforcement agency on a permanent basis to deal with the problem.

    The Committee also informed the Court that the Construction Task Force set up by the MCD to deal with unauthorised constructions was playing no role in the demolitions and was only doing the job of collecting information about illegal structures .
