High Court takes serious note of incident at Nizamuddin

Assault on court appointed receiver for Nizamuddin dargah


  • Receiver and a lawyer were also prevented from entering the dargah
  • Apology of the Pirzadas of the dargah rejected

    NEW DELHI: The Delhi High Court on Monday took a serious note of the assault on Court-appointed personnel to take over the Hazarat Nizamuddin dargah here.

    When the receiver, Azimul Haque, along with lawyer Nazmi Waziri had gone to take over the dargah on Sunday following a Court direction, they were assaulted and prevented from entering the premises.

    In his report, the Station House Officer (SHO) of the Nizamuddin police station informed a Division Bench of the Court comprising Justice Vijender Jain and Justice Kailash Gambhir that a criminal case had been registered in the matter.

    Counsel for the "Pirzadas" of the dargah apologised to the Court for the incident and assured full cooperation in the implementation of the Court order. However, the Bench rejected the apology saying that the culprits were yet to be identified.

    The Bench said that the culprits when identified would be prosecuted for the assault as well as face criminal contempt of court proceedings separately.

    The Court directed the Police Commissioner to provide 24-hour security to Mr. Waziri and his family as well as Mr. Haque.

    The Court had on August 17 appointed Mr. Haque and asked him to take over its functioning saying that the present management had made a mockery of the administration.

    Disposing of a public interest litigation, the High Court had in 2005 directed the Waqf Board to take charge of the dargah and ensured that no third party collected any of the offerings there.

    The petitioner, non-government organisation Hum Aapke, had alleged that the "Pirzadas" and their agents of the Nizamuddin dargah misappropriated the offerings and kept no account of the same.
