Bangalore: The jinx on the prestigious Arkavathy Layout continued with the Karnataka High Court on Wednesday quashing the orders of the Bangalore Development Authority (BDA) in respect of those lands in which discrimination was alleged during the acquisition. Several landowners had moved the High Court challenging the order of the BDA Commissioner. A Division Bench of the High Court, while giving the go-ahead to the Arkavathy Layout in November 2005, had said that if the lands fell under the green belt area or if they were totally built up or belonged to charitable trusts, educational and religious institutions, nursery lands, factories or lands (similar to lands) which had not been notified prior to the preliminary notification, applications may be filed before the BDA seeking exclusion from acquisition. Based on this directive, several landowners had filed applications before the BDA.
Documents
They had produced documents to support their case. The petitioners contended that the BDA Commissioner had issued an endorsement stating that their (petitioners) land did not fall under the above mentioned category and the same could be acquired. Justice Mohan Shantangouder on Wednesday directed the Land Acquisition Officer (LAO) of the BDA to redo the matter after holding spot inspections. He quashed the impugned orders by the BDA and directed the BDA and the parties to maintain status quo. He directed the parties to complete the fresh proceedings expeditiously but not later than six months.
