Cases against Jayalalithaa, Sasikala adjourned to September 22

Matter pertains to non-filing of Income Tax returns

CHENNAI: Additional Chief Metropolitan Magistrate, Economic Offences-I, J.V. Raj, on Friday adjourned to September 22 cases against former Chief Minister Jayalalithaa and her associate Sasikala, for their alleged failure to file income tax returns.

The court said as the entire material parts of records had been submitted to the High Court, commencement of hearing fixed for the day could not be proceeded with. Hence for reasons contained in the adjournment petition (that was filed), the case was being adjourned.

During the last hearing, the Economic Offences court had fixed for Friday commencement of hearing as per the apex court orders. The Additional CMM had said that the accused should appear in the court.

When the case was taken up, the accused were not present. Counsel N. Jothi and L.P. Shanmugasundaram filed a petition seeking adjournment in which it was submitted that a batch of writ petitions and criminal revision petitions was listed before Justice K. Ravirajapandian on Thursday. The Judge expressed his unwillingness to proceed with the case and requested the Chief Justice to post the same before some other Judge.

Defence counsel said larger questions were involved before the High Court. In view of the pendency of petitions, the maximum limit of adjournment possible may be granted.

Senior Special Public Prosecutor, Income Tax department, K. Ramasamy, said as per the Supreme Court order, the court had fixed the date of hearing and had also said that the accused should appear on Friday. Hence, the work had to be in accordance with the apex court order.

The Additional CMM later adjourned the case.

The matter pertains to the non-filing of income tax returns by Ms. Jayalalithaa and Ms. Sasikala for the assessment year 1993-94. The other cases were that besides Sasi Enterprises, the two failed to file returns in their capacity as partners of the firm for the assessment years 1991-92 and 1992-93.
