The State Government is likely to file a review petition in the Karnataka High Court on Monday seeking exemption for pillion rider from the helmet rule for two-wheeler riders.
Home Minister M.P. Prakash, who chaired a high-level meeting with senior officials, told The Hindu that the enforcement of the helmet rule depended on the admission of the review petition and the ruling of the court.
The plea of the State Government was that it had received several objections from the people against making helmets compulsory for pillion riders of the two-wheelers.
The High Court in an order on A public interest litigation approved the undertaking given by the State Government in 2003 that the wearing of helmets would be made compulsory for the rider and the pillion rider. In a way, the Government was now trying to seek a change in the undertaking it had given to the court. The public interest litigation was filed soon after amendments were introduced to the Indian Motor Vehicles Act and thereafter to the Karnataka Motor Vehicles Act wherein the wearing of helmets was made compulsory.
Meanwhile, Bangalore Police Commissioner N. Achuta Rao, in accordance with a Government Order issued two months ago, has said that the helmet rule, including for the pillion rider, would be implemented from September 1.
