Kozhikode: The Kozhikode Additional District Session Court on Tuesday found six National Development Front (NDF) activists guilty on the charges of murdering a Communist Party of India (Marxist) worker, Eeethullathil Veertil Binu, 22, at Nadapuram in 2001. The verdict will be delivered on Friday. Judge A.M. Babu found the accused from one to five, B.C. Basheer, 36; E. Usman, 31; Abdul Rafeek, 28; Rayaroth Meethal Nizar, 31 and K. Nazar, 36 and 12th accused K. Naufal guilty under Section 302 (murder), 143 (unlawful assembly), 147(rioting), 148 (rioting with armed weapons), 149 (unlawful assembly guilty of offence committed in prosecution of common object) and 506 (i) (criminal intimidation) of the Indian Penal Code. All the accused hail from various places in Wayanad and Kozhikode districts. The other five accused, from six to eleven, V. Nizar, 36; M. Sadath, 34; V. Soopy 50; K. Mohammed Ali, 43; P. Hameed, 47 and K.S. Basheer, 45, were acquitted in the case. The prosecution failed to prove the charges against them, all activists of the NDF. The case related to the murder of Binu, a jeep driver at the taxi stand at Kallachi town in Nadapuram on June 2, 2001. Binu was the first accused in the Theruvamparambu gang-rape case. The Indian Union Muslim League made it a poll issue in the Assembly elections in 2001. The alleged gang-rape incident occurred on January 15, 2001. According to the prosecution, the victim Nabeesa was attacked and she and her seven-year-old daughter were gang raped during the riots at Nadapuram during that time. Binu was murdered as a sequel to this case. However, the District Additional Sessions Fast Track (First) in March this year acquitted the 12 accused, all CPI (M) activists on charges of rape in the case. But six of them were sentenced to two years' imprisonment and imposed a fine of Rs.5,000 each on the charge of attacking the house of the victim and destroying household utensils. A large posse of policemen was deployed for duty at the court complex in Kozhikode from morning. Bomb and dog squads were pressed into service to inspect the areas.
