BANGALORE: The Bangalore Mahanagara Palike (BMP) has filed a compliance report before the Karnataka High Court on the issue of grant of building licence and alleged violations in a building coming up adjacent to the Mount Carmel College at Vasanthnagar here. In its report, the BMP said there were violations in the building under construction and sought permission to remove the deviated portions. It said it had inspected the premises and issued preliminary and confirmatory orders under Section 321 (1) and 321 (2) of the KMC Act to the builder. When the petitioner did not receive the provisional notice on July 18, it was sent again to him and was also pasted on the walls of the building. A confirmatory order was issued on August 3. Justice Rammohan Reddy adjourned further hearing on the matter.
Dismissed
A Division Bench comprising Justice B. Padmaraj and Justice S. Abdul Nazeer on Friday dismissed petitions by the Bangalore Golf Club and several others challenging the levy of tax under the Societies Act for filing of list and balance sheets. The appellants urged the Bench to set aside a single judge order upholding an amendment to the Karnataka Societies Registration Act, 1960. The appellants contended that the amendment targeted better-off clubs and was discriminatory in nature.
Appeals
A Division Bench comprising Justice V. Gopal Gowda and Justice C.R. Kumaraswamy dismissed appeals by the National Highways Authority of India (NHAI) challenging the enhanced compensation awarded to landowners whose land were acquired by it for building bridges in Mangalore. The NHAI acquired their land in 1994 by paying them Rs. 5,000 an acre. The landowners had referred the matter to the district court. The Principal District and Sessions Court of Mangalore citing a Supreme Court and Full Bench ruling of the Karnataka High Court had enhanced the compensation to Rs. 22,800 an acre. The NHAI had contended that there was a vast difference between the amount arrived at by the land acquisition officer and the district court. The Bench dismissed the appeals.
Direction
A Division Bench comprising Justice R. Gururajan and Justice N. Ananda on Friday allowed petitions by Chandrakant Baddi of Hubli, Amaravati Shashikala of Raichur and another person, and set aside their detention under the (Karnataka Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Gamblers, Goondas and Slum Grabbers Act, 1988) Goonda Act. It directed the Registry to send a copy of the order made in all the three cases to the Chief Secretary of the State, the Home Secretary and the Director-General and Inspector-General of Police. The detainees were ordered released if they were not wanted in any other case.
Warrant
A Division Bench comprising Chief Justice Cyriac Joseph and Justice N. Kumar on Friday directed issue of a non-bailable warrant against a resident of Bangalore. The Bench asked the city police to serve the warrant on Sriramulu after the court was told that he was not present though he was directed during the last date of hearing to be present in court. The court had taken up contempt proceedings against Sriramulu for misleading it by fabricating records and creating a fictitious person.
