dated September 7, 1956: High Court Judges

During discussion on the Constitution (Ninth Amendment) Bill in the Lok Sabha on September 5, there was an interesting debate on the question of allowing High Court Judges to practise in the Supreme Court and in the courts of States where they had not acted as Judges. Replying to the debate, Mr. B.N. Datar, Minister in the Ministry of Home Affairs, said that High Court and Supreme Court Judges should be men of great experience and ripe wisdom. The Government was anxious that the judiciary was manned by the most talented persons in the country. The earlier restriction that retired Judges of High Courts should not practise had led to a disinclination on the part of the best advocates to accept the post of a High Court Judge. There was always a strong desire on the part of a successful advocate to practise. Therefore, to provide for what he called "this understandable human weakness," the Government had now laid down that retired High Court Judges could practise only in the Supreme Court and in the High Courts other than those where they were Judges.
