Judge for alternative dispute resolution

`It will restore the people's confidence in judiciary'

Sirsi: The alternative dispute resolution system (ADRS) can be effective in India as it was not a new concept to the legal dispensation system, Vishnu Sabhahit, Judge, High Court of Karnataka, has said.

Mr. Sabhahit was delivering a 14th G.N. Vaidya Endowment lecture on "Dynamics and dimensions of alternative Dispute resolution systems", organised by the MES Law College, Sirsi, and Bar Association, Sirsi, here on Saturday at MES Commerce College Silver Jubilee Hall.

He said forums of settlement of disputes could change depending on the mode of settlement opted by parties or ordered by courts.

Prompt and speedy disposal of disputes would strengthen such forums and revive the trust and confidence of public in legal profession, Mr. Sabhahit added.

But the introduction of ADRS would not eliminate disputes and litigations entirely.

It would only reduce period of pendency of litigation, he said.

India had a long tradition of arbitration. The villages had a judicial system of their own which was respected by the people.

He said an accumulation of cases in courts and the delay in their disposal showed the need for speedy and inexpensive justice delivery system.

Law Commission report

To implement the 129th report of the Law Commission and to make conciliation scheme effective, it was proposed to make it obligatory to refer the dispute for settlement either by way of arbitration, conciliation, mediation, judicial settlement or through Lok Adalat.

If the disputes persisted, only then the suit would be pursued in the court, Mr. Sabhahit said.

MES president V.S. Sonde welcomed the gathering.
