Prosecution begins arguments in Rahul Mahajan case

    NEW DELHI: The prosecution in the drug abuse case involving Rahul Mahajan, son of late BJP leader Pramod Mahajan, and others began arguments on the charges on Thursday.

    Lab tests prove intake

    In his submission, Chief Public Prosecutor B.S. Joon submitted before Special Judge for Narcotic Drugs and Psychotropic Substances (NDPS) Act cases S.M. Gupta that it had been forensically proved that Mr. Mahajan and Bibek Moitra, former personal secretary of the late BJP leader, had taken a cocktail of "morphine,'' "cocaine'' and "heroin'' at the 7 Safdarjung Road official residence of his father in the early hours of June 2 this year.

    Moitra had died due to overdose of the drugs, the prosecution said.

    Mr. Joon stated that the forensic examination of the empty pouch recovered from 7 Safdarjung Road and the gastric wash of Mr. Mahajan and Moitra proved that the two had taken a cocktail of the three drugs.

    Statements recorded

    Mr. Joon further stated that the prosecution had recorded the statements of as many as 79 witnesses to prove the case, and the statements of the three of the witnesses — Karan Ahuja, Trishya Khanna and Rahul Malhotra — were recorded under Section 164 of the Criminal Procedure Code (Cr.P.C.) before a Metropolitan Magistrate.

    Meanwhile, Mr. Gupta asked the prosecution to find out whether Rakesh Malhotra, who was admitted to Apollo Hospital here with a complaint of unknown poisoning on the same date and around the time when Mr. Mahajan was rushed to the hospital, was related to the drug abuse case.

    The Delhi police in August charge-sheeted Mr. Mahajan, Harish Sharma, former personal assistant of the late BJP leader, Sahil Zaroo, a friend of Moitra, and three others in the case.

    The police charge-sheeted Mr. Mahajan under Sections 21 (possession of drugs), Section 25 (allowing premises for commission of an offence), Section 27 (illegal possession in small quantity for personal consumption of any narcotic drugs), Section 27A (financing illicit traffic and harbouring offenders), and Section 29 (abetment and criminal conspiracy) of the NDPS Act.

    The charge sheet said that Sahil had procured the drugs at the instance of Mr. Mahajan and later the two along with Moitra had taken them at 7 Safdarjung Road.
