CHENNAI: A habeas corpus petition, challenging the re-arrest of Nepalese Maoist leader Chandra Prakash Gajurel, allegedly inside the Chennai Central Prison premises, has been filed in the Madras High Court. A Division Bench comprising Justice P. Sathasivam and Justice S. Tamilvanan, before which the HCP filed by advocate S. Sencodi came up for hearing, directed the Additional Public Prosecutor to ascertain if there was any West Bengal court order or arrest warrant pending against the Maoist leader. He is also to find out whether an earlier writ petition filed by Mr. Gajurel seeking to quash a prisoner-on-transit warrant against him, was pending. The matter was then adjourned to Tuesday for further proceedings. In her petition, Ms. Sencodi submitted that the New Jalpaiguri police from West Bengal had illegally arrested Mr. Gajurel inside the jail premises without informing him the grounds of arrest. His family members were also not informed. It was in violation of the court orders and vitiated the proceedings. She prayed for a direction to the police to produce Mr. Gajurel in court and set him at liberty forthwith.
