Hearing on Jamma Malai lands adjourned

State seeks time to file additional affidavit

BANGALORE: The Karnataka High Court on Wednesday adjourned hearing on a public interest litigation (PIL) petition on the encroachment of Jamma Malai lands in Kodagu district after the Government sought more time to file an additional affidavit on the issue.

When the matter came up, Government advocate A.N. Venugopala Gowda submitted that the Chief Secretary needed more time to file an additional affidavit on the encroachment of these lands.

He said an earlier report by the Chief Secretary had already been submitted.

The court was dealing with a PIL by Bharatiya Janata Party (BJP) leader, Pramila Nesargi, seeking a direction to the authorities not to transfer 468 acres of land in Chelevara village at Napoklu Nad in Kodagu district alleged to have been sold to former Minister T. John and also to restrain him from collecting the forest produce or use the land for non-forest purposes.

The High Court had on November 15, 2005 directed the Chief Secretary to investigate the encroachment of the lands in 13,736.80 acres.

A Division Bench comprising Chief Justice Cyriac Joseph and Justice K. Bhakthavatsala adjourned further hearing on the case.

A Division Bench comprising Chief Justice Cyriac Joseph and Justice K. Bhakthavatsala on Wednesday directed the Government advocate to ascertain from the Government on whether any action or decision was taken by it on a report submitted by the Lokayukta on the Rs. 231-crore scandal in the seven civic bodies adjoining Bangalore city.

A PIL petition was filed by S. Vasudeva, advocate, seeking a direction to the State Government to take action on the report.
