ELURU: District Judge K.V. Giridharan on Wednesday disqualified the election of Mote Chalapalti Rao of Telugu Desam Party as a corporator from 12th division in Eluru Municipal Corporation on grounds of tax evasion. Responding to a petition filed by Somisetti Srinivasulu, who lost the election as a rival candidate against Mr Chalapati Rao, the Judge also impleaded the State Election Commission, the district Collector and the municipal commissioner for their `failure' to go into the merits of the claims of the petitioner and ensure corrective measures in time. According to the prosecution, the EMC authorities gave a no-due certificate to the TDP candidate, also a cable TV operator, in spite of the fact that he was due to pay the corporation entertainment tax. Of the total outstanding dues of Rs 54,000, he paid the corporation only Rs 31,500 at the time of the election. The rival candidate filed a petition in the District Court seeking countermanding of the election by invoking Section 23 of the Corporation Act which disqualifies anybody who resorts to any kind of tax evasion to continue as a member. R. Ronald Raju counselled for the petitioner.
