CHENNAI: A parent has moved the Madras High Court, stating that even four years after the alleged rape by a person of two minors, one of them his daughter, and murder of his eight-year-old son, the Nagapattinam police had not arrested the sole accused named in the First Information Report (FIR). Justice R. Regupathi, expressing shock at the lack of any progress in the case, has directed the Government advocate to obtain instructions from the district police and submit a reply within a week. The petitioner alleged he and his wife left for their respective offices on October 4, 2002 when the accused person entered the house and raped his daughter and his niece, who had come to his house on a vacation. Both the girls were minors and the offence was committed at knife-point, he said. The accused had slit the throat of his son as he had raised an alarm, according to the petitioner. He further contended that though the Nagapattinam police registered the case on October 4, 2002, there was no progress in the investigation and the accused was not arrested. According to him, even the intervention of the Superintendent of Police did not yield any result. Besides, he said he and his family members were receiving threatening calls from the accused, warning them against proceeding with the case. In this regard, he said he had submitted a representation to the District Collector on January 31, 2005, seeking protection to the family members as well as the expeditious investigation of the case. "But, so far nothing has materialised in this regard," he submitted. "Having lost faith in the fairness of the investigation by the Nagapattinam police" the petitioner prayed for a direction to transfer the probe to the CB-CID.
