CHENNAI: The investigation into a case relating to the death of a married woman under mysterious circumstances has been entrusted to the CB-CID by the Madras High Court. Justice R. Regupathi passed the order after the victim's father R. Doraisamy said the Perundurai police in Erode district did not register a murder case and investigate the matter properly because the main accused was a head constable in the same station. The petitioner said his daughter Kalaiselvi was married to Gnanasekaran, a head constable in the Perundurai police station. He said his son-in-law used to beat up his daughter and harass her for more dowry. On June 29, 2006, he was informed that his daughter had died. When he visited the house, he found her dead with many injuries on her body. Claiming that she had been murdered by her husband the petitioner lodged a complaint with the local police. However, instead of registering a murder case, the police had filed a case for commission of offence under Section 498A (Cruelty committed on a married woman by her husband and his relatives) and 306 (abetment of suicide) against Gnanasekaran. He further contended that the respondent-police, despite the lapse of over two months, failed to initiate any investigation. He said the police were attempting to shield the accused because he was attached with the same police station. The police personnel in the station had failed to discharge their duties, he said, and prayed for a direction transferring the investigation of the case from the local police to the CB-CID. Acceding to the plea, Mr. Justice Regupathi directed the immediate transfer of the case. He asked the local police to hand over all the case diary papers to the Erode district Superintendent of Police. The investigation shall be done by an officer not below the rank of the Deputy Superintendent of Police, he added.
