COIMBATORE: The prosecuting agency in the Coimbatore serial blasts case has failed to comply with the Indian Explosives Rules while handling the recovered explosive materials, thus giving room for suspicion, defence counsel P. Thirumalairajan submitted on Wednesday before K. Uthirapathy, judge of the Special Court for Bomb Blast Cases. He was arguing along with Bhavani B. Mohan, while T. Balasundaram and T.A. Selvaraj represented the prosecution. Mr. Thirumalairajan said the prosecuting agency had failed to inform the Controller of Explosives within 48-hours of the seizure. Instead of sending the seized materials to the Joint Chief Controller of Explosives, the competent authority, the agency had despatched it to the Tamil Nadu Commando School and forensic laboratory. It had despatched three sets of explosives, especially high-grade explosives such as Tri-Nitro Toluene and Plastic Explosive Kirki, giving room for suspicion that it had a huge stock of explosives using them "conveniently" against the accused for framing charges. He accused the prosecution of wilful suppression of facts and material documents relating to seizure of explosives. Violation of rules and unexplained questions by the prosecution strengthened the suspicion that the entire theory of arrests and seizures at Rajamundry was concocted.
