BANGALORE: The Karnataka High Court admitted a petition by a student from Gulbarga seeking a direction for grant of a medical seat. It, however, refused to pass any orders on her request for grant of a medical seat. The petitioner, Swetha S., said she had obtained 9117th rank but was told that there is no seat vacant under Scheduled Caste (SC) category for MBBS seats and she was provisionally admitted to BDS courses in HKE's Dental College in Gulbarga. Swetha said she was shocked when on July 1, 2006, the Health and Family Welfare Department published a seat matrix for MBBS for Government and management quota seats. She said if merit had been followed, she would have got a medical seat. A Division Bench comprising Chief Justice Cyriac Joseph and Justice Ajit Gunjal said it did not consider it proper to issue any interim order to admit her to first year MBBS course as the allotment process has been completed and the last date for admission is September 30. If the petitioner was entitled to a seat, she would be entitled to such a relief. The case was adjourned to November 3.
