BANGALORE: The Karnataka High Court on Friday stayed the operation of a notice issued by the Bangalore Mahanagara Palike (BMP) directing a doctor in Sadashivanagar not to continue use of the premises as a nursing home. Petitioner Sujaya Shetty said her father had retired as head of the Radiology Department of Bangalore Medical College (BMC) and in 1986 he had set up Ganesh Nursing Home in Sadashivanagar. The petitioner said that in 1986 there was no bar under any rule in running a nursing home in a residential area. The petitioner the regulations of the Comprehensive Development Plan of 1995 did not prohibit the use of land and buildings that already existed. She said the BMP had issued notices under Section 308 read with Section 505 of the Karnataka Municipal Corporation Act, 1976, stating that there was change in land use and that the building could only be used for residential purposes and not commercial purposes. She said although they had replied to the notice, the BMP did not consider them. The BMP then issued a notice on September 6 asking her to ensure that the building could not be used for commercial purposes. Another similar notice was sent on September 21. The petitioner urged the court to quash the notice and stay its operation. Justice A.S. Bopanna stayed the operation of the notice and adjourned hearing on the case.
Bal plea rejected
Justice Jawad Rahim on Friday rejected an application for bail by Suresh Shetty, a native of Shimoga, who was arrested by the police on charge of criminal intimidation and kidnapping. Suresh Shetty had moved the High Court after the District and Sessions Judge, Shimoga, had dismissed his application for bail. State Public Prosecutor S. Dore Raju opposed the grant of bail, saying that Shetty was part of a 26-member gang of contractors in Shimoga that was involved in criminal intimidation, wrongful confinement and kidnapping.
