BANGALORE: The Karnataka High Court on Friday came to the rescue of a resort in Mysore and directed the district authorities and the police to unlock the premises which they had sealed on Thursday. "The Roost", a resort, bar and restaurant located at Hinkal in Mysore had moved the court after the village accountant of Hinkal and a Revenue Inspector, along with the police, entered the premises at 11.30 a.m., and locked the main gate of the premises. The respondents, "The Roost" claimed, had sent out all its customers and termed this action highly objectionable and illegal. In his petition, K.B. Dilip, the managing director of The Roost and M.K. Chengappa said the resort had come up on katha no. 43 (survey no. 218). They said the resort consisted of a ground and first floor building with 10 double rooms, two conference halls, bar and restaurant. They said the building was completed in 1998. Citing the provisions of the Urban Land Ceiling and Regulation Act of 1976, the authorities had decided to lock the premises. They termed this action illegal and ultra vires and urged the court to direct the respondents not to interfere with the possession of the property.
Adjourned
Justice N.K. Patil directed the authorities to unlock the premises and adjourned further hearing on the case.
