KOLLAM: P. Ramabhadran, president of the Kerala Dalit Federation (KDF), has said the recent Supreme Court verdict on "excluding the creamy layer within scheduled communities from the purview of reservation in public appointments and promotions" is yet another instance of negative judicial activism. In a statement here on Sunday, Mr. Ramabhadran said the verdict made one wonder whether courts had taken up the task of enacting laws. He said that among the scheduled communities there was no creamy layer. The court verdict was feared to be one that would serve to deny reservation to the scheduled communities under the label of a non-existent creamy layer. That in turn would result in these communities becoming more and more backward. Its repercussion would be serious, he warned. The Dalit leader the apex court coming out with such verdicts exposed the bankruptcy of democracy and the failure of country's Parliament. He wanted Parliament to come out with a legislation that would overrule the verdict.
