New Delhi: Mere fulfilment of educational qualification criteria does not entitle a person to a particular post on compassionate grounds as this yardstick would then be exploited by every aspirant seeking top posts in civil and judicial services, the Delhi High Court has observed. "Merely fulfilling the qualifications does not reflect upon the level of competency of a person for the appointment to a post. If this principle is to be followed, then a graduate would be eligible to claim the appointment of an IAS/IPS and a law graduate would claim the position of a Judge on compassionate grounds," Justice S.N. Dhingra observed. Setting aside an order passed by an Industrial Tribunal for the appointment of a matriculate to the post of Lower Division Clerk (LDC) on compassionate grounds, he said the appointment of a person for a government job on such grounds could be done on the basis of merit and not on that of educational qualification alone. Passing an order in favour of the Municipal Corporation of Delhi (MCD), the court said, "Every matriculate is not capable of being appointed as a clerk. The person has to qualify a competitive examination by which his competence to become a clerk is tested." - PTI
