BANGALORE: If it is a case of misinterpretation of law, no action is recommended against any official in the absence of material to show that it was done with mala fide intention. This has been the stand taken by the Lokayukta before Governor T.N. Chaturvedi, who had queried about the absence comments about the official role in a complaint made against K.H. Gopalakrishne Gowda, former Registrar of Cooperative Societies, in the matter of the exemption granted in March 2005 to four Bangalore-based housing cooperative societies from payment of stamp duty and registration fees. The complaint was that Mr. Gowda had approved bylaws of four house building cooperative societies (HBCS) Canara Union Cooperative Housing Society, Dattaprasad Housing Society, Chitrapur Housing Society and Paresh Housing Society in Malleswaram in March 2005, as a result of which the four societies were exempted from payment of stamp duty and registration fees for all the transactions relating to the flats prior to April 2001. Mr. Gowda had declared that the Karnataka Stamp Act, Registration Act and Transfer of Property Act would not be applicable to the four societies.
