CHENNAI: The Madras High Court has declined to stay a State Government order of May 15, 2006, reverting senior police officer P. Sivanandi from the post of Deputy Inspector-General of Police to that of Superintendent of Police. A Division Bench dismissed Mr. Sivanandi's stay petition, it admitted his main writ petition to quash the May 15 order of the State Government as well as the November 1 order of the Central Administrative Tribunal (CAT) rejecting his original application against the demotion order. The Bench, comprising Justice Elipe Dharma Rao and Justice S.K. Krishnan, passed the interim order on Thursday. Earlier, when the matter was taken up, senior counsel A.L. Somayaji submitted that the Centre alone had the jurisdiction to revise the year of allotment, and the State Government had acted in haste and reverted Mr. Sivanandi to the post of Superintendent of Police. However, referring to an earlier interim order of a Division Bench, Additional Solicitor-General V.T. Gopalan and Advocate-General R. Viduthalai opposed any interim relief to the officer and argued that it was not open to him to bring up the matter again before a Bench here.
