Bench annoyed at AG's absence

New Delhi: The Supreme Court on Friday expressed displeasure at the non-appearance of Attorney-General Milon Banerjee.

Even as Additional Solicitor-General Gopal Subramanium was about to commence his arguments on Parliament's power to include laws in the Ninth Schedule, the court said: "We had issued notice to the AG and wanted him to be present and not an attorney on his behalf. The AG should have the courtesy to appear before the nine-judge Bench at least for five minutes especially when the matter is of such importance and going on for the last five days. There was no concept of an attorney holder for the AG. You are just counsel and your submissions cannot be treated as that of the AG. We have our reservations about such practice."

Mr. Subramanium said the AG was unwell but the Bench did not accept this as the reason for his non-appearance.
