NEW DELHI: The Union Cabinet on Thursday approved the introduction of a Judges (Inquiry) Bill 2006 in the winter session of Parliament with a view to making High Court and Supreme Court Judges accountable for their actions, including corruption and incapacity. The Bill seeks to regulate the procedure for investigation and proof of misbehaviour or incapacity of a judge of the Supreme Court or High Court and for presentation of an address in Parliament and for matters connected therewith. According to the Government, the move will bring transparency in the functioning of the judiciary and enhance its prestige. It seeks to give effect to some of the recommendations of the Law Commission in its 195th report. The Council is empowered to issue, from time to time, a Code of Conduct that comprises guidelines for the conduct and behaviour of judges. The Code provides for annual disclosure of assets and liabilities of judges to the Chief Justice of India (CJI) or High Court Chief Justices. The Bill, which seeks to amend the 1968 Act, contemplates establishment of a Judicial Council, comprising the CJI; two senior-most judges of the apex court and two senior- most High Court Chief Justices to be nominated by the CJI. Any one can make a complaint to the Judicial Council against judges of the Supreme Court (except the CJI), High Chief Justices and judges. If a complaint is against a Supreme Court judge, the council will consist of the CJI and four senior-most judges. If a complaint is against the CJI, then he will not take part in the proceedings. The President shall nominate the next senior-most judge of the apex court. There is a provision for preliminary scrutiny and verification by the council.
