Woman gets relief under Domestic Violence Act

Man to pay maintenance under Rajasthan's first case under the Act

JAIPUR: In the first case under the Domestic Violence Act in Rajasthan, a city court here has ordered a man to pay maintenance to his estranged wife as temporary relief and directed the police to provide protection to the woman now living with her parents.

Santosh Chauhan, a resident of Jawahar Nagar, had accused her husband, Hiralal Chauhan, and three others of harassing and torturing her with the demand for dowry. She said her in-laws turned her, along with her children, out of her marital home in Kotputli after beating her last month.

Twenty-six-year-old Santosh moved the court under Sections 18, 19 and 20 of the newly enacted Domestic Violence Act seeking orders for her protection and maintenance from her husband. She alleged that Hiralal and her brothers-in-law were threatening her even after ousting her from home.

Judicial Magistrate Israr Khokhar passed an interim order on Monday directing Hiralal to pay his wife a monthly allowance of Rs. 1,500 while rejecting his contention that Santosh had slapped a false case of dowry harassment and had left the house on her own.

The court ordered Hiralal to pay maintenance till the final disposal of the case to meet his wife's subsistence expenses for herself and her children as well as the medical expenses. Hiralal was also directed to desist from indulging in any act of violence against his wife or threatening or abusing her.

The Magistrate had last week ordered the officer in-charge of the Jawahar Nagar police station to extend protection to Santosh at her parents' home so that neither her husband nor anyone sent by him could threaten or attack her.

The Protection Officers under the Act are yet to be appointed in the State.
