Kochi: The Kerala High Court on Thursday dismissed two writ petitions filed by V. Devayani and S.R. Balasubramanyam, chairperson and vice-chairperson respectively of the Palakkad Municipality, challenging the no-confidence motion moved against the vice-chairperson. The petitions were dismissed by Justice Pius C. Kuriakose. The court said that the 17 members who signed the no-confidence motion had owned up their signature in an affidavit filed before the court. The court noted that the signature put on the affidavit filed by Ms. Devayani and also in her writ petition were not similar. It appeared to the court that she did not have a "consistent signature". Besides, the court pointed out that she did not have a case that the signature was not put by her. On the other hand, her contention was that she had signed some blank papers and given to her party leadership. The party leaders misused it. The court noted that she was yet to initiate any action against the party leadership for misusing her signature. The judge added that there was force in the contention of those who signed the no-confidence motion that she raised the allegations as an afterthought. According to the petitioners, the signature given on the blank papers by the councillors was misused for moving the no-confidence motion. A meeting of the Palakkad Council is scheduled for November 18 for considering the no-confidence motion.
Charges to be read out
A Full Bench comprising Justice J. B. Koshy, Justice A.K. Basheer and Justice K.P. Balachandran on Wednesday ordered that the charge sheet in the contempt of court petition filed against the former Minister Cherkulam Abdulla would be read out on January 17, 2007. The contempt petition was filed by P. Damodaran, secretary, Kerala Vyapari Vyavasyi Samithy, Kasaragod. According to him, the demonstration led by the then minister in connection with the reception given to him after he assumed office was against the guidelines of the Full Bench on demonstrations and processions. The petitioner said the procession taken out at Cheruvathoor on July 1, 2001, turned violent and IUML workers attacked the houses of other party workers and destroyed public property. The Full Bench said that the Malayalam translation of the charges would be given to him within two weeks. After receipt of the charges, the former Minister should give his explanation within one month.
