New Delhi: The Supreme Court has issued contempt notice to two IAS officers, M. Devaraj, Secretary, Commercial Tax and Religious Endowment Department, and S. Muthusamy, Inspector-General of Registration, for their alleged failure to implement its order. A Bench of Justices A.R. Lakshmanan and Altamas Kabir issued the notice on a contempt petition moved by K. Madalaimuthu and A. Arumuga Nainar, alleging that the officers had violated the July 4 order. The Bench, after hearing counsel B. Balaji, issued notice to them returnable in four weeks. It said for the time being personal appearance of the officers would be dispensed with. In their contempt petition, Mr. Madalaimuthu and Mr. Nainar, Assistant IGs of Registration, submitted that the two respondents, by their orders dated July 25 and August 10, had promoted a junior. Both had wilfully and deliberately disobeyed the judgment. They contended that as per the judgment, the apex court had directed the contemnors to re-determine the seniority of the petitioners in relation to the promotees after reckoning the starting point of seniority of such promotees from the date of regularisation of their services and not from the date of initial appointment. They made representation to the contemnors to implement the apex court judgment but their representations were ignored and orders passed to promote a junior as Additional IG of Registration. The Madras High Court had granted interim stay on a petition challenging the order.
