CVC has recommended prosecution No closure report filed: Centre
New Delhi: The Supreme Court will give its ruling on Monday whether or not to direct the Central Bureau of Investigation (CBI) to file a charge sheet against the former Uttar Pradesh Chief Minister Mayawati in the Rs. 175- crore Taj heritage project scam. The court reserved verdict in July.
CVC recommends prosecution
Based on the opinion given by the Attorney-General Milon K. Banerjee, the CBI Director decided not to proceed against Ms. Mayawati. However, the Central Vigilance Commission, which was asked to scrutinise the CBI material on the investigation, recommended that she be prosecuted.
Mayawati's contention
Ms. Mayawati argued that once the CBI Director decided to drop the case, no outside force could recommend that it be continued. The CVC had no power to direct how the CBI should conclude the proceedings.
U.P. Government's plea
The Uttar Pradesh Government contended that the CBI should be allowed to file the charge sheet or, in the alternative, all case material placed before the magistrate concerned, who would decide whether the charge sheet should be filed or not. The Centre made it clear that no closure report was filed and it would be open to the court to pass appropriate orders.
