Assembly passes resolution to introduce Tamil as the High Court language

Government will provide necessary infrastructure: Karunanidhi

CHENNAI: The State Assembly on Wednesday unanimously passed a resolution to introduce Tamil as the court language of the Madras High Court, where all the proceedings were being conducted in English.

Moving the resolution, Chief Minister M.Karunanidhi said the Government would provide all necessary infrastructure to implement the proposal, as suggested by the Chief Justice of the High Court.

"Historical decision"

Describing the move as "a historical decision," the Government resolution said the Assembly unanimously resolved to "request the President to accord his consent for implementing this decision expeditiously."

The resolution pointed out that Article 348 (1) of the Constitution provided for all proceedings in both the Supreme Court and the High Courts to be in English.

However, Article 348 (2) read with Section 7 of the Official Languages Act, 1963 provided for the proceedings of the High Court to be in the official language of the State subject to the authorisation of the Governor, after obtaining the consent of the President. "In accordance with the policy that all administrative activities must be carried on in the official language of the State, the Government has decided to introduce Tamil in orders, decrees and other proceedings of the Madras High Court" as per this Constitutional provision, it said.

Mr. Karunanidhi regretted that Members belonging to the All India Anna Dravida Munnetra Kazhagam and the Marumalarchi Dravida Munnetra Kazhagam were not present when the resolution was passed in the House.

Suggestions relating to selection of translators well versed in English and Tamil, well-trained stenos and additional staff for translation of articles for `Theerpu Thirattu', a Tamil law journal, would be implemented.

The Government would also fulfil other requirements related to developing a Tamil software and setting up of a separate library for keeping law books and notes in Tamil, he said.
