NEW DELHI : The Delhi High Court on Thursday issued a notice to the Uttar Pradesh police on a bail application moved by Vikas Yadav, prime accused in the Nitish Katara murder case. Justice A.K. Sikri directed the police to file a reply by December 18. While refusing to hear his bail application, the Supreme Court had last week asked Vikas Yadav to move the High Court for relief. The High Court had earlier this year rejected his bail, observing that he could move the Court for relief after Bharti Yadav, a key prosecution witness, recorded her evidence. Vikas, through his counsel, submitted that since Ms. Bharti had recorded her evidence before a trial court here recently, the Court should consider his application. He also submitted that Vishal Yadav, a cousin and the other accused in the case, had already been granted bail. Ms. Bharti, sister of Vikas Yadav, recorded her statement last week disowning her statement with the police that she was in love with Nitish Katara and intended to marry him. Vikas and Vishal, brother and cousin of Ms. Bharti, are facing trial for allegedly kidnapping Nitish Katara, son of a former IAS officer here, and later killing him because they were against their sister having an affair with him.
