CHENNAI: The Madras High Court has declined to interfere with the Bar Council of Tamil Nadu's prohibitory order against a person, who was practising as an advocate while working in the Health Department of Chennai Corporation. At the time of his enrolment in November 1987, A. Kaliselvan was working as Male Field Worker in the Health Department of the Corporation of Chennai. As for his failure to declare his employment status in the application form, he said, "I understood that the particulars regarding employment pertains to past/previous employment... "
Compulsorily retired
After issuing a show-cause notice to him in April 2005, the BCT passed the impugned order in June 2005 prohibiting him from practising. In July 2006, the Chennai Corporation compulsorily retired him from service. Pointing out that he was not in service anymore, he said, "Now that my service had come to an end, there may not be any difficulty on the part of the BCT from allowing me to resume my practice." Since there was no response to his plea, Mr. Kalaiselvan preferred the writ plea.
However, refusing to interfere with the prohibitory order, Justice K. Chandru said: "The charges levelled against the petitioner are very serious in nature and hence the prohibitory order was issued by the Bar Council. Even if the State Bar Council takes an adverse decision against the petitioner, it is always the right of the petitioner to appeal to the Bar Council of India and thereafter to the Supreme Court."
