Tender notification for new DGP office quashed

CHENNAI: The tender notification issued in 2004 for the construction of a new Director-General of Police office complex at Taramani here was quashed by the Madras High Court on Wednesday.

Passing orders on a writ petition filed by the Indian Institute of Architecture, Justice M.E.N. Patrudu ruled that even if any contract had been finalised in favour of any third party it would become null and void.

State unit chairman of the Indian Institute of Architecture J. Manoharan, in his petition, challenged the January 2004 notification contending that the eligibility requirements for participating in the process had been designed in a particular manner with a view to exclude all except some "pre-determined ones." He sought to quash the tender notification published on December 19, 2003 and an amendment notice published on January 11, 2004.

On January 31, 2004 a single judge had admitted the plea and made it clear that award of the tender to any third party would be subject to the outcome of the petition.

TNPHC denial

In its counter-affidavit, the Tamil Nadu Police Housing Corporation denied that it had purposely included "onerous conditions" in the tender document, but added that "as a floater of the tender it is open to the TNPHC to call for tender with conditions required by it in order to get the best person to do the job."

As for the petitioner's allegation that the authorities had not followed the provisions of the Architects Act 1972, the TNPHC said it was not under the purview of the Act. Describing the petition as wholly misconceived, the counter said, "The THPHC is governed by the Transparency in Tenders Act 1998," and added that it was the latest Act, which would prevail over the Architects Act.
