Challenges order quashing the setting up of Bannerjee committee

AHMEDABAD: The Railway Ministry has filed a letter patent appeal in the Gujarat High Court challenging the earlier order of a Single Judge Bench quashing the constitution of the U.C. Bannerjee Committee to probe into the Godhra train fire.

On October 13, Justice D.N. Patel held the Ministry's notification constituting the committee, which later was upgraded to the level of judicial commission, as illegal and unconstitutional on the ground that the Ministry and the Centre had no jurisdiction to constitute the committee.

The court also restrained the Centre from presenting the committee's report before Parliament or taking further action on the basis of the report.
