Kochi: A Division Bench of the Kerala High Court on Tuesday directed the landowners who challenged the land acquisition for the rail link to the proposed Vallarpadam transhipment terminal to file an application seeking to examine the viability of the project before the authorities concerned. The Bench comprising Chief Justice V.K. Bali and Justice S. Siri Jagan observed that the application would be considered in accordance with the law. Disposing of the petition seeking to review the dismissal of a writ petition, the court said the authorities concerned could not have undertaken such a mammoth project without examining its viability. The court observed that before starting the project the respondents would examine the viability in the light of the contentions made by the petitioners. However, the government pleader submitted that a notification under the Kerala Land Acquisitions Act had been issued and that it was done after assessing the feasibility of the project. The court observed that it did not want to deal with the issue at this stage.
