KOLKATA: Rajinder S. Lodha scored a point in his legal battle against the Birlas, with the Calcutta High Court on Thursday upholding a lower court verdict that three Birla family members had no caveatable interest in his probate petition for the M.P. Birla group's Rs.5,000 crore assets. A Division Bench, comprising Justices P.C. Ghose and T.K. Dutt, rejected the appeals of K.K. Birla, B.K. Birla and Yashovardhan Birla challenging an earlier order of Justice K.J. Sengupta. It, however, upheld the caveatable interest of another Birla family member, G.P. Birla, executor of the purported 1982 will of M.P. Birla and his wife Priyamvada and the appointment of Yashovardhan Birla as executor of the will, rejecting Mr. Lodha's appeal. The four Birla family members earlier claimed caveatable interest in Mr. Lodha's plea for probate of the purported will of Priyamvada Birla of 1999, as per which the entire estate of the M.P. Birla group was bequeathed to Mr. Lodha. PTI
