Man facing externment avails of RTI

NEW DELHI: A man against whom the Delhi police had initiated externment proceedings has been allowed by the Central Information Commission to have a look at the report on the basis of which he was being externed.

Nahar Singh, a resident of Sultanpuri in North-West Delhi, had been served a notice (No.1964) under Section 50 of the Delhi Police Act pertaining to initiation of externment proceedings against him early this year. The Information Commissioner observed that the proceedings under Section 50 of the Delhi Police Act had been initiated against the appellant on the basis of a report from the lower police officers to their superiors. "In the normal course, this report should be made available to the person against whom it is made so as to enable him to prepare his defence, he said. However, considering that revealing the identities of persons who deposed against the appellant might put them at risk, their names should be blacked out from the files concerned, ruled the Information Commissioner. The Delhi police have been given two weeks to furnish the information sought.
