Delhi High Court summons case file

To ascertain whether Bharti Yadav was having an affair with the deceased

NEW DELHI: The Delhi High Court on Tuesday summoned from the trial court the file of the Nitish Katara murder case to ascertain whether Bharti Yadav, daughter of former Member of Parliament D. P. Yadav and a key prosecution witness in the case, was having an affair with deceased Nitish Katara as alleged by the prosecution.

Justice A.K. Sikri of the High Court summoned the file when Standing Counsel Mukta Gupta submitted that the contents of greeting cards sent by Ms. Bharti to Nitish established the prosecution's version that she was in love with Nitish.

Ms. Gupta submitted this argument while opposing a bail application by Vikas Yadav, prime accused in the case.

Mr. Justice Sikri directed the trial court to send the case file by a special messenger on January 8.

While refusing to hear his bail application, the Supreme Court had in December last year asked Vikas Yadav to move the High Court for the relief.

Bail rejected

The High Court had last year rejected his bail plea observing that he could move the Court for the relief after Ms. Bharti recorded her evidence.

In his application, Vikas Yadav through his counsel submitted that since Ms. Bharti had recorded her evidence, the Court should consider his bail application.

He also submitted that Vishal Yadav, cousin of Vikas Yadav and the other accused in the case, had already been granted bail.

Statement

Ms. Bharti, sister of Vikas Yadav, recorded her statement in November disowning her police statement that she was having an affair with Nitish and intended to marry him.

Vikas and Vishal, brother and cousin of Ms. Bharti respectively, are facing trial in the case for allegedly kidnapping Nitish, son of a former IAS officer here, and later killing him because they were allegedly against their sister having an affair with him.
