Court may examine Bharti Yadav's sister

To verify whether she received calls on her sister's cell


NEW DELHI: The lower court conducting trial of the Nitish Katara murder case here on Wednesday issued notices to Vikas Yadav and Vishal Yadav on an application by the prosecution seeking summoning of Bhawna, sister of Bharti Yadav, to verify whether Ms. Bharti had received calls from Neelam Katara, mother of deceased Nitish Katara, and his friends on Ms. Bhawna's mobile on February 16 when Nitish had gone missing and on the following day in 2002.

Vikas and Vishal are facing prosecution in the case.

Recording her evidence in the case in November last year, Ms. Bharti, a key prosecution witness in the case, had categorically denied having used Bhawna's cell number 9810038469 or receiving any call from the above-mentioned persons on it.

The said number was issued to Ms. Bhawna at the residential address of R-4/32 at Rajnagar in Ghaziabad that belongs to former Member of Parliament D.P. Yadav, father of Ms. Bharti and Ms. Bhawna.

The prosecution said that it was very essential to examine Ms. Bhawna to ascertain who was using the cell bearing the above-mentioned number on the relevant dates and time in the view of the denial by Ms. Bharti.The prosecution also sought summoning of the record of the then bank account of Nitish Katara from the Kasturba Gandhi Marg branch of HDFC Bank here to see whether the cheque for Rs. 10,000 that Ms. Bharti had issued in favour of the Connaught Place branch of BNP Paribas Bank drawn on HDFC Bank at the time of opening her account in September 2001 belonged to the deceased.

Important evidence

The record is a very material piece of evidence and its production is essential for a just and proper disposal of this case, the application said.

The prosecution further stated that Ms. Bharti had also said in her evidence that she had given the address of Nitish Katara in the bank opening account form, and after his murder she had changed the address by giving the address of Ms. Bhawna's office-cum-residence at 14, Gulmohar Park in South Delhi.

Ms. Bharti had also submitted to the bank a certificate issued by Oswal Sugar Limited and signed by Ms. Bhawna as its manager (co-ordination) requesting it to register B-14, Gulmohar Park as the new address in the account record of Ms. Bharti, the prosecution stated.
