Corporation rapped for failing to execute court order

CHENNAI
: Rapping the Chennai Corporation authorities for their failure to implement a 2003 order to remove a temple structure at Thiruvalluvar Nagar in Tiruvanmiyur, the Madras High Court has directed them to remove the Muthumariamman Alayam "forthwith."
The First Bench comprising Chief Justice A.P. Shah and Justice K. Chandru also directed the High Court Registry to issue a show-cause notice to the `trustee' of the Muthumariamman Alayam Trust asking why contempt of court proceedings should not be initiated against him.
Rejecting the Corporation's plea for four week's time to remove the structure, the Bench said that if the persons responsible for the temple failed to remove the structure on their own, the authorities would implement the order.
When the public interest litigation petition was taken up for disposal, the Tamil Nadu Housing Board (TNHB) submitted that the structure was occupying a land meant for being used as a road.
The Corporation submitted that it was "unobjectionable," and that the petition could be dismissed.
In 1996, the TNHB granted the land to the Corporation as part of the Tiruvanmiyur Extension of Neighbourhood Scheme, which had provisions for park, residential areas and roads.
The temple is situated at the junction of 9th Cross Street and II Main Road.
