CBI files charge sheet in bogus insurance claim case

CHENNAI: The Anti-Corruption Branch of the CBI has filed a first charge sheet in a bogus motor accident insurance claim case.

It had taken over the investigation as instructed by the Madras High Court.

The charge sheet, filed in the court of the Chief Judicial Magistrate, Madurai, is against five persons for offences under sections 120-B (criminal conspiracy), 182 (false information, with intent to cause public servant to use his lawful power to the injury of another person), 420 (cheating and dishonestly inducing delivery of property) and 511 (punishment for attempting to commit offences punishable with imprisonment for life or other imprisonment) of the Indian Penal Code.

The charge

According to the charge sheet, K. Karuppasamy of Tirunelveli, who did not possess a valid licence to drive a motorcycle, was injured in December 2005 while driving the vehicle belonging to his father T.Karuppasamy, the insurance policy of which had lapsed. The motorcycle skidded off the road.

S. Ramakrishnan, an advocate clerk, advised Mr. T. Karuppasamy to ask his son to prefer a false complaint that he had fallen down from a two-wheeler while riding pillion. A complaint was preferred.

V. Karuppasamy, a cousin of T. Karuppasamy, allowed his motorcycle, which was insured, to be mentioned as the vehicle involved in the accident. V. Madasamy of Tirunelveli, brother of V. Karuppasamy, who had a driving licence, admitted before the magistrate court that he had driven the motorcycle rashly.

Plea withdrawn

K. Karuppasamy filed a petition before the Motor Accidents Claims Tribunal, Tirunelveli, seeking a compensation of Rs.10 lakh. After the CBI took over investigation, the petition was withdrawn and disposed of as not pressed.

The court has taken cognisance of the CBI charge sheet, CBI sources said.
