CHENNAI: The Pattali Makkal Katchi on Thursday said the Supreme Court judgment on the validity of the Ninth Schedule would create confusion as it sought to subject over 200 laws to judicial scrutiny. "Central Government and States should act immediately and explore as to how to avoid this problem," S. Ramadoss, party founder, said in a statement. Remarking that the judgment will lead to primacy of individual's rights over interests of the people, Dr. Ramadoss said there was no second opinion to safeguard individual's rights. However, in a democracy, people's interests were supreme. If the laws were to be subjected to scrutiny, taking into account individual rights and disregarding interests of the public, a situation might arise for not executing people-oriented laws, he said. Parliament and Legislative Assemblies would lose their independence. Janata Party president Subramanian Swamy welcomed the judgment. "After the concept of basic structure of the Constitution was accepted by the nation following the Supreme Court judgment in the Keshavananda Bharati case, Parliament became a creation of the Constitution. Hence, whatever legislation Parliament passes has to be liable to judicial review by the High Court and Supreme Court," he added.
