Boy has his way at court

Staff Reporter

DINDIGUL: Attching importance to the wish of a child, Judicial Magistrate Court-I today issued a decree on Thursday allowing him to go with his father.

Panchavarnam, wife of Murugan of Ragalapuram in Dindigul, had filed a petition seeking direction from the court to get back her son from her husband. She charged that her husband planned a second marriage.

On hearing the case, the judge Sanjeev Baskar interacted with the child to know his wish in the court. Five-year-old Prakash told the judge that he wanted to stay with his father only.

The lawyers of Panchavarnam argued that a child below seven years must go with its mother only.

The judge, quoting previous judgments, pointed out that the child could not be coerced, and no decision could be taken against the child's wish.

Later, he ordered the child to go with his father.
