NEW DELHI : The Delhi High Court on Thursday restrained an Additional Chief Metropolitan Magistrate (ACMM) court here from conducting proceedings till further orders against six doctors and seven non-medical staff members of the Apollo Hospital here in the Rahul Mahajan drug abuse case.The Delhi police charged the hospital management with having given "wrong information" about the treatment provided to the son of the slain Bharatiya Janata Party leader Pramod Mahajan in June 2006. Justice Reva Khetrapal stayed the proceedings on a petition by two of the 13 accused seeking quashing of the First Information Report.The Sarita Vihar police chargesheeted the accused on November 2 last under Sections 182 (giving false information to a public servant on oath), 201 (destruction of evidence), 109 (abetment in any offence), 114 (abetment in any offence if abettor is present when offence is committed) and 120-B (criminal conspiracy) of the Indian Penal Code for misleading the investigation and tampering with evidence. Taking cognisance of the charge sheet, ACMM Kamini Lau asked the accused to appear on January 12. The petitioners Dr. Prasad Rao and Dr. Awadesh Bansal said there was nothing on record to warrant their prosecution under Sections 201 and 182 because they had neither caused the disappearance of any material, let alone evidence, nor given false information to the investigating officer. Further hearings will be held on February 5.
