CHENNAI : The Madras High Court has directed the Thyagaraya Nagar Social Club administration to hold free, fair and proper election to the club by "strictly adhering to rules, regulations and byelaws." Justice S. Rajeswaran, disposing of an original application filed by P.S. Ashok @ Sinora Ashok and M.S. Kathikeya Balaji, gave the direction after recording an undertaking given to that effect by the incumbent office-bearers. The applicants had sought to restrain the club management from permitting any third parties, outsiders and non-members of the club into the premises during the annual general body meeting and elections. They also sought appointment of an independent observer for monitoring the electoral process.
"No prima facie case"
Pointing out that the applicants had not come to the court in their representative capacity, Justice Rajeswaran said they had not made out a prima facie case. He also referred to an undertaking given by the club authorities that a foolproof system would be adopted and that all members attending the meeting would be asked to sign an attendance register and furnish identity cards. During the polling, even office-bearers would not be allowed to enter the hall, it said.
