A trial court here had sentenced Sharma to death in the case in 2003. A Division Bench of the Court comprising Justice R.S. Sodhi and Justice P.K. Bhasin reserved the judgment on the conclusion of arguments by Sushil Sharma's counsel, K.K. Sud, and Delhi Standing counsel Mukta Gupta for the prosecution. Mr. Sud submitted that the case was investigated in a perfunctory manner and the trial in the lower court was conducted in a surcharged atmosphere under media hype that affected the case of his client adversely. He further argued that the police had planted the weapon of offence, a revolver, and had obtained the forensic report about it fraudulently. Countering his submission, Ms. Gupta supported the trial court judgment stating that the prosecution had proved the case beyond all reasonable doubts. Naina Sahni, who Sushil Sharma had claimed as his wife, was murdered in her rented house at Gole Market in New Delhi in 1995. The Delhi police alleged that after the murder, Sushil Sharma had cut his wife's body into pieces, stuffed them into a gunny bag and brought it to a hotel's restaurant for disposal in the tandoor (oven). However, a vigilant beat constable of the city police had foiled his bid after spotting parts of the body beside the oven. The police rushed to the spot and recovered the badly burnt body parts of Naina.
