Ex-inspector convicted for custodial death

Sentence to be pronounced on Tuesday

NEW DELHI: A city court here on Saturday convicted a retired Delhi Police inspector for culpable homicide not amounting to murder in a 17-year-old case of death in custody. Four others, including the landlord of the victim, were also convicted for voluntarily causing hurt to the victim, Subhash Chand.

Additional Sessions Judge Rajender Kumar convicted H. P. Singh, who was then the Station House Officer of the Geeta Colony police station, after finding sufficient evidence against him. Landlord Budh Prakash and three of his acquaintances, Sudesh Rani, Ashok Kumar and Shammi, were also convicted. The quantum of sentences would be pronounced on Tuesday.

The prosecution had said in its case that Subhash Chand, a tenant in the house of Budh Prakash, had an altercation with him on January 23, 1990, following which the police were informed. The victim was booked under preventive sections and taken to the police station.

There, the SHO beat up Subhash inflicting injuries on his spinal cord. Subhash was admitted to LNJP Hospital where he succumbed to his injuries a week later.

Subsequently an FIR was registered against Inspector Singh. Later, Subhash's wife also told the police that Budh Prakash and three others had also severely beaten up Subhash. Budh Prakash and the other three were then booked for voluntarily causing hurt.

The maximum punishment under Section 304 of the Indian Penal Code is life imprisonment, while the maximum punishment for voluntarily causing hurt is imprisonment up to one year or a fine of Rs. 1,000, or both.

The same court had recently awarded death sentence to a retired Assistant Commissioner of Police in a case of custody death.
